Court Upholds Former Attorneys Sex Offender Registry Conviction

Image
Court of Appeals has upheld the conviction of a Charles City man who failed to register as a sex offender after being found guilty of fondling a teen boy in 2011. Douglas Kent Lindaman former attorney and magistrate, defended his sex offender registry that he wasn’t required to register with authorities because he had posted an appeal bond following the guilty verdict on charges of assault with intent to commit sexual abuse in the summer of 2018. He also tried to argue that his conviction was set aside while his appeal was pending, and he unsuccessfully tried to put those theories before the jury in his failure to register trial. But in an opinion handed down , the Iowa Court of Appeals sided with the state and ruled Lindaman was properly barred from espousing his misinterpretation of the law to the jury. According to court records, an Iowa Division of Criminal Investigation agent and a Floyd County sheriff’s deputy approached Lindaman at his home following the 2018 verdict and expla

Coronavirus Is Making It Harder For Domestic Violence Victims To Find a Place To Live

Image
As states across the country rush to curb the surge in coronavirus cases, once again the safest place for anyone to be is home. But for victims of domestic violence , home is far from a safe haven. The coronavirus has led to a surge in domestic violence, leaving victims and their children struggling to find access to food, safe housing, and transportation, according to a new study by Rutgers University. A team of researchers spoke with 83 victims of domestic violence over a nine-month period, beginning with the moment they left their abusive relationships and entered into a domestic violence shelter. They then tracked their progress over time to see what happens once a victim leaves. The study showed that some victims were met with various challenges and barriers including a lack of food, shelter, transportation, childcare, and opportunities for employment that pressured them to live in communities near their abusive partners. Others were forced to move back in with their abusers afte

Benefits Of Hiring A Criminal Defense Lawyer

Image
Legal issues do not arise often in most lives, but when they occur, few people have the knowledge of local laws and processes needed to protect their rights and ensure the best outcome.  When you bring your first case to a Detroit Sex Crimes Attorney , you gain the benefits of attorneys that can provide the benefits and support you need for a wide range of legal issues. Being accused of a criminal offense can be scary and distressing, whether you’re at fault or innocent. It can even be more upsetting when the other party is hell-bent on sending you to jail, and they have government resources to do it. Plus, the legal and criminal process can be quite confusing and overwhelming for a first-timer. There is plenty of paperwork to file, questions to answer from police officers, and evidence to gather. Any small mistake with these processes could jeopardize your case and mean a higher sentence, fine, or harsh charge on your record. You shouldn’t take chances.  Hiring a professional sex cri

Aggressive Detroit Criminal Defense Lawyer

Image
The Motor City is home to over 700,000 people, and is the largest city in Michigan. According to Forbes Magazine, the Detroit-Livonia-Dearborn metropolitan area is the most dangerous place in America, and the city has some of the country’s highest crime rates.  Over 90 crimes per 1,000 residents occur annually, creating a dangerous reputation of delinquency for the area. Prosecutors will try to put anyone accused of a crime behind bars in efforts to lower the crime rate, but run the risk of convicting many innocent people and unnecessarily filling Michigan jails. Those convicted of a crime in Detroit can face stiff legal penalties, including jail time, probation, and fines. On top of these legal consequences, those convicted of a crime also face limited professional opportunities due to their criminal record. Employers often deny those with a criminal record a job, regardless of whether the conviction was related to the work. In many cases, those with a criminal record can also be deni

What Is 2nd Degree CSC

Image
Second-degree criminal sexual conduct is a serious felony offense involving unwanted sexual touching, in many instances of a minor, a person with a mental or physical disability, or someone over whom you hold the power that you are suspected of using to coerce sexual activity. In other states, second-degree criminal sexual conduct might be charged as sexual battery or child molestation if the victim is a minor under a certain age. If you are convicted of second-degree sex crime , the consequences you face are severe, and some are life-long. You may be sentenced to years in prison, may be ordered to pay costly criminal fines and court costs, must submit to electronic monitoring for the rest of your life, have a permanent criminal record as a sex offender, limited in where you can live and may be denied housing because of your criminal record, you may lose your job or be turned down for work because of your felony record, and you’ll be restricted from doing certain kinds of jobs. Middle School Teacher Accused of Sexting Minor

Image
Sexting is sending, receiving, or forwarding sexually explicit messages, photographs, or images, primarily between mobile phones, of oneself to others. It may also include the use of a computer or any digital device. The term was first popularized early in the 21st century and is a portmanteau of sex and texting, where the latter is meant in the wide sense of sending a text possibly with images. A teacher from Greco Middle School was arrested and charged with sending sexual messages to a minor who goes to the school. Deputies began investigating James Michaud, 28, a couple of weeks ago, after the parents of the 13-year-old victim filed a complaint against the AVID coordinator and teacher. An arrest warrant shows the teacher and student sent messages on Instagram to each other from January of 2020 until September of this same year. Boy’s mother got concerned when she realized her son was spending so much time with the student outside of the classroom, the warrant shows. Records show Mi

Common Mistakes To Avoid If You're Arrested

Image
It can be frightening to get arrested. Being cuffed and led to a police station can be nerve-wracking. That's why you need to know all mistakes to avoid when arrested . Sometimes it is okay when the system is prejudiced or flawed; this can result in problems. The first thing that police often say to you is your Miranda rights. One of these is your right to remain silent. This is why when the policemen start asking you questions, you have every right to clam up. Most people forget this. For example, when a police officer asks whether you are drunk, don’t just up and admit it. Remember the other part of the Miranda Rights is that anything you say can be used against you, so don’t admit a crime while being arrested. The biggest mistake that people make is to talk about their case with friends, family, cellmates, law enforcement, and others. Law enforcement is allowed to lie to you in order to obtain a confession or in order to gain evidence to support a conviction. Your family members

According to court documents, Johnson has previously engaged in this type of activity. In September 2012, Johnson’s former wife discovered a bag of VCR tapes. On two of the tapes, Johnson discusses his desire to have sexual relations with a minor. On another tape, Johnson speaks with a woman wh

Sexual Abuse Allegations Against ex-Councilor

Lawsuit against Kernersville YMCA is headed to the N.C. Court of Appeals. The lawsuit alleges that officials at Kernersville YMCA did nothing about allegations a counselor sexually assaulted nine men when they were boys in the 1990s and early 2000s. Attorneys for the YMCA are filing a sex crime appeal for the decision of a Forsyth County judge to transfer the lawsuit to Wake County to resolve a motion to dismiss the suit. The men suing the YMCA argued that the motion dealt with constitutional issues that could potentially jeopardize the state law that made it easier for victims of child sexual abuse to file civil lawsuits. Attorneys for the men said a three-judge panel in Wake County should decide the issues and not a Forsyth County judge.   Judge Richard Gottlieb of Forsyth Superior Court agreed, sending the case to Wake County. But last month, Gray Wilson and Lorin Lapidus, attorneys for the YMCA, filed a notice of appeal. The current legal dispute is over a law known as SAFE, whic

Israeli Court Approves Extradition Of Sex Crime Suspect

Israeli court ruled that a former principal of an Australian school accused of sexually assaulting students could be extradited to Australia for trial, but implementation could be held up by an sex crime appeal . Malka Leifer has fought her return to Australia, including with a submission of mental illness, dragging the case on since 2014. Leifer, who was the principal of an ultra-Orthodox Jewish school in Melbourne, has denied the allegations against her. Jerusalem District Court, having ruled in May that Leifer was fit to face trial on the basis of a series of psychiatric examinations, decided at Monday's session that she could be extradited. It gave her 30 days to lodge an appeal with Israel's Supreme Court, and Leifer's lawyers said a challenge against extradition would be mounted there. Leifer is wanted by Australian police on 74 sexual assault charges, including rape, involving girls at her former school. She fled Australia in 2008 with what Australian authorities be

Bill Cosby's Appeal of Sex Crimes

Pennsylvania Supreme Court said Tuesday that it had accepted convicted Bill Cosby's sex crime appeal of his 2018 conviction, thus raising the possibility it might be overturned in the future.  The court limited its review to two key issues from Cosby's appeal, which were raised during his two trials on charges of drugging and raping a woman at his Pennsylvania home in January 2004.   Under Pennsylvania law, the high court did not have to accept Cosby's nearly 300-page appeal, in which he raised multiple issues objecting to the conduct of his two trials.  Andrew Wyatt, a spokesman for Cosby, 82 and now serving a three-to-10 year sentence in a state prison, said the former TV icon is extremely thankful. In its one-page order, the Supreme Court said it would review the appellate panel's decision on Cosby's case based first on whether the trial judge's decision to allow other accusers to testify about alleged, uncharged prior bad acts by Cosby was prejudicial as op

The mother then reported it to police and using the description the girl used and information Cre

Jury Trials to Slowly Return in Miami

As South Florida coronavirus numbers plummet and local governments ease restrictions, Miami-Dade’s criminal court is planning how to resume jury trials, slowly and safely, to ease what figures to be a significant backlog of cases. Even so, virtual proceedings aren’t going anywhere anytime soon — and new flash points are emerging over how to maintain public safety while keeping the justice system limping along. Defense lawyers are challenging Miami-Dade judges who are expanding the use of Zoom, including one who ordered a probation-violation hearing that could send a man to prison for life. And prosecutors are challenging a judge who suggested a homeless woman undergo a Zoom deposition — from the outdoor vacant lot where she stays. For the entire summer, the system inched along, with only emergency hearings held in person, and Zoom being used for hearings. Among those hearings: ones regarding scheduling, to get defendants out of jails while awaiting trial, plea deals, and even hearings

The Michigan State Police Computer Crimes Unit and Internet Crimes Against Children Task Force announced Thursday that Chelsea Nicole Dunbar, of Romulus, had been charged with multiple counts of production, distribution, and aggravated possession of child sexually abusive material and first-degree criminal sexual conduct. Authorities said the investigation began in June, when law enforcement became aware of Dunbar possessing files of child pornography. Further investigation revealed a child victim in the case, police said. A search warrant was executed in Romulus, where Dunbar was taken into custody and the child victim was accounted for, police said. During the investigation, task force members said they became aware that the Detroit Police Department was investigating another internet account used by Dunbar for child sexuall

DuMouchelle tricked North Dakota businessman Thomas Ritter into wiring $12 million to invest in the diamond last year. Instead, DuMouchelle on Monday admitted withdrawing most of the money and spending the cash. Detroit Lawyer Prosecutors believe Ritter is among 26 victims who either gave DuMouchelle money or jewelry to sell, Assistant U.S. Attorney Karen Reynolds said. The government believes the loss to victims is more than $25 million, though DuMouchelle lawyer Jonathan Epstein believes the loss could be less. At the time, the jeweler owed $430,000

Date Rape Suspect Charge For The 2nd Times

Date rape is a form of acquaintance rape and dating violence. The two phrases are often used interchangeably, but date rape specifically refers to a rape in which there has been some sort of romantic or potentially sexual relationship between the two parties. Acquaintance rape also includes rapes in which the victim and perpetrator have been in a non-romantic, non-sexual relationship, for example as co-workers or neighbors.  A Pleasant View man charged earlier this year in Ogden in an alleged date rape has been arrested again in connection with a similar 2016 case. The Davis County Attorney’s Office last week filed six felony charges against Kade Duane Peterson, 22, alleging he assaulted an 18-year-old woman in Farmington four years ago.  Farmington Police Department said the woman reported she and Peterson met on social media and arranged a date on Sept. 29, 2016. She said they drove to a Farmington parking lot and they climbed into the back seat and Peterson started kissing her. Pe

A Defense Overview

A Defense For The Accused is either a denial of having committed a wrongful act or a justification for what would otherwise be regarded as criminal behaviour. For a defence to succeed, the accused must produce evidence that supports it. Most often, defendants go with the claim that they simply did not commit the alleged act in question. They might argue that someone else committed the crime or that no crime was committed in the first place. A defense attorney taking the position that no offense happened might claim that witnesses versions of events are untrue or that the client's actions didn't satisfy all the elements of the offense. There are several other defences available that do not qualify either as mental states or justifications. An accused person may not claim mistake of law, or ignorance of the law, as a defence for committing a criminal act. However, an important exception is in the case of an accused relying on the erroneous legal advice of an official such as a

R. Kelly Remains Locked Up

 R. Kelly got put in a really bad spot by guards at the Chicago prison where he's locked up, and then they ignored his concerns of being in danger before R Kelly attacked in jail according to his legal team. Steven Greenberg and Nicole Blank Becker, tell a lot of the animosity toward Kelly within the Metropolitan Correctional Center is due to some of the prison guards telling the inmates that they had to go on lockdown because of protests outside the facility for R. Kelly. Kelly's lawyers and prosecutors in the Northern District of Illinois argued via telephone before Judge Harry Leinenweber Wednesday about Kelly's motion seeking immediate release due to the alleged inability of the federal Bureau of Prisons to protect his safety in the Metropolitan Correctional Center in Chicago. Leinenweber rejected an immediate release. But he set deadlines for the prosecution and defense lawyers to file briefs on Kelly's motion for an evidentiary hearing to interrogate under oath M
