The Blank Law, PC

Criminal law is a complex body of state and federal legislation. In fact, each state often sets its own definitions and punishments for state crimes. The majority of crimes are state crimes. Exceptions include causing damage to federal property or inflicting injury upon a federal employee. A criminal defense lawyer may be contacted directly by the defendant or may be assigned the case by the court. Many criminal defense lawyers are public defenders who are paid by the public defender’s office. They are appointed cases by local, state or federal courts. Other criminal defense lawyers are hired by private firms. Some criminal defense lawyers have an independent legal office that they man themselves. Public defenders tend to be paid a lower salary than private lawyers and also tend to have a higher case load due to the referral process and the pay coming from individuals other than defendants. In some cases, a court may appoint a private lawyer to take a specific case. Experience is key

In cases of alleged abuse, the judge will thoroughly investigate each claim before awarding custody or visitation. This often leads to time-consuming and expensive examinations by medical and mental health experts, which can be especially burdensome for children.  Jail or prison sentences are very common with child abuse convictions. Reasons Why Calling An Attorney

In this world of do it yourself fixes and the wealth of information available through the internet, people have a tendency to spend untold hours attempting to solve their problems without calling someone for help. While there is certainly merit to that as it embodies the American spirit with its work ethic and self-reliance, everyone needs help sometimes. If you do decide that legal help is the best option in your situation, then it is normally best to Call A Lawyer immediately. If you have been injured in an accident there may be certain time limits that you need to abide by when filing a lawsuit. They can vary across state lines and can vary depending on a number of other factors.  Also, witnesses move, memories fade, and evidence may be harder to secure the more time passes.  Additionally, many lawyers you hire will likely need time to prepare before any legal process, therefore enlisting one early on will give them ample time to build your case. Reasons Why Hiring an Attorney Early in the Process of Sex Crime Case

Hiring an attorney early in a Criminal Sexual Conduct case is important because in most sex crimes cases, police will try to interview the accused person. In this interview, the investigator will ask questions that can be designed to elicit incriminating responses. Even though the person may be innocent of a sex crime, that person may give an answer that can incriminate him or her. One should NEVER speak to the police about a criminal situation, Especially a criminal sexual conduct crime, without an attorney because an attorney can spot these issues in the interview and advise innocent clients not to respond. Practically speaking, hiring an attorney early in the case means being able to access the documentation and discovery with ease, being able to have your questions answered, having a skilled advocate with experience negotiating your matter with the Attorney, and having someone there who can advise you on the appropriate pace for litigating the case. For example, if you were charge

Registered Sex Offender Arrested

A Mountain Home man and a registered sex offender have been arrested on felony charges related to a sex crime committed against a juvenile male. The arrest comes after an investigation into a complaint to the Sheriff’s office they received on August 5. The mother of a 15-year-old reported that the child told her that 59-year-old David Carleton had molested him while swimming at the Robinson Point Campground in July. According to the Sheriff’s office, the child was subsequently interviewed about the incident. It was alleged that when Carleton and the child were swimming, Carleton forcefully grabbed the child’s private parts, and then the child pushed Carleton away. The child explained to investigators that Carleton had been buying him and his brother’s toys and other items prior to the event. It was said by the Sheriff’s office that Carleton would often take the children fishing on Norfork and Bull Shoals Lakes and also on the White River, and they had been swimming together previously

RIOT-RELATED PROPERTY CRIMES

While some Black Lives Matter advocates are calling on the Lane County District Attorney's office to drop charges against those allegedly involved in May's riot, the DA's office said it plans to prosecute property-related crimes among others. According to the Eugene Police Department, 13 people have been arrested and jailed in connection to the riot, which took place on West 7th Avenue and Washington Street May 29 overnight into May 30.  Local Black Lives Matter group BIPOC Liberation Collective posted on social media Wednesday asking supporters to call the DA's office to demand the charges against the alleged rioters be dropped. In the post, the organization said that black voices were being repressed and said, "Property doesn’t have feelings, people do." Lane County Prosecutor Chris Parosa said that the county will prosecute cases involving property damage, theft, and confrontations that threatened personal safety.  "When the exercise of their constitu

Slaying Of Pregnant Woman and Toddler

Another person is responsible for the deaths of Jackie DeFoe and Kevin Shabaiash Jr., an attorney asserted this week. A Cloquet man had "absolutely no motive" to kill his pregnant girlfriend and her toddler, and prosecutors have no physical evidence linking him to the crime, a defense attorney said. Three murder charges against Sheldon James Thompson should therefore be dismissed for a lack of probable cause, attorney Kassius Benson told the court in a filing this week. "The state's case is based largely upon the unreliable, uncorroborated and unsubstantiated statements of witnesses who claim that Mr. Thompson made admissions to them," Benson wrote. "Mr. Thompson did not make any such admission to any third party. To be clear, Mr. Thompson did not commit any act leading to the death of the victims." Thompson, 33, is charged with killing 27-year-old Jackie DeFoe, who was 13 weeks pregnant with his child, along with her 20-month-old son, Kevin Shabaiash

Turner, who is charged with five felony counts of manufacturing/delivering Schedule I or II narcotics and four felony counts of first-degree recklessly endangering safety. Turner was charged after a party July 28 at her residence in the 8800 block of 17th Avenue that ended with her fiance dying of an apparent overdose. Three others also overdosed, but were revived with Narcan at the scene. Keating set a judicial pre-trial in the case for Oct. 1 at 10:30 a.m. Turner pleaded not guilty to all nine charges during an arraignment after the preliminary hearing. Defense attorney Matthew Jones told Keating he didn’t feel the state met i

More Than 100 People Arrested After Looting Batters Downtown

The city briefly raised most of the bridges to the main shopping and business district. Mayor Lori Lightfoot condemned the crowd’s actions as “abject criminal behavior.” All summer, demonstrators have marched through Chicago to protest police misconduct. In many neighborhoods, gun violence has been unrelenting, soaring to levels not seen in decades. The coronavirus pandemic is resurging, now sickening hundreds of people each day. Then early Monday morning, hundreds of people, spurred by a police shooting and by calls on social media to take action in the gleaming heart of the city, converged on the Magnificent Mile, Chicago’s most famous shopping district. They broke windows, looted stores and clashed with the police, a chaotic and confusing scene that prompted city officials to briefly raise bridges downtown and halt nearby public transit to stem the unrest. Two people were shot and at least 13 police officers were injured. The events instantly played into the broader political dynami

If allegations are brought against you, you can be assured that police will conduct a thorough investigation and that prosecution will most likely begin to build a case against you. If you’re experiencing false allegations, it’s essential to work with a lawyer that understands the burden of proof. Far too often, lawyers allow the prosecution to force the defense to prove innocence; however, it’s the prosecution’s job to prove guilt. Punishments for Criminal Sexual Conduct 1st Degree: Maximum sentence of life in prison 2nd Degree: Maximum sentence of 15 years –
